When you are pulled over on suspicion of drunk driving and your blood alcohol level registers above the legal limit on a breath test, or if you refused to submit to a test, you have the right to a civil hearing conducted by the DMV. The purpose of the hearing is to determine if your driver's license will be suspended or revoked.
Within seven days of your DUI or DWAI arrest, you must request a DMV hearing (unless you took a blood test in which case the Department of Motor Vehicles will mail notice to the last known address that they have notifying you of your results).
