Challenging the Breathalyzer Test
There are a number of factors to consider if Breathalyzer test results were used to charge you with DUI or DWAI. I consider the following to determine if the results of a Breathalyzer test were valid:
- Was the police officer certified to administer the test?
- Did any chemical factors affect the results of the test, such as hypoglycemia?
- Was the machine properly programmed?
- Did the police officer follow the 20-minute observation period before administering the Breathalyzer test?
- Was the test administered within two hours of when the defendant was operating a motor vehicle?
- Were other testing standards met?
Challenging Blood Alcohol Content (BAC) Tests
When an individual is arrested for suspicion of drunk driving, a BAC test will be administered at the police station or hospital. Once hired, our firm immediately obtains the blood sample and has it tested at a private laboratory. If there is a big discrepancy between the two BAC tests (the one administered by the police and the one tested in the private lab) we will work to determine what factors affected the results of each test individually, and to determine what our client's actual BAC level was. We will also investigate other factors that may affect the results of a BAC test.
